Role purpose
To be the key person within the Council leading on all negotiations with the EA on the Flood Alleviation Scheme, one of the biggest flood schemes in the country.
To work as part of a wider project team to achieve best value delivery of the Flood Alleviation Scheme, whilst working to maintain the Council's best interests.
To report to the Internal Board and ensure liaison and dissemination of information related to the scheme across the wider Council. The scheme will impact on 70+ titles of City Council Land
Role responsibilities and main duties
To negotiate the terms of an Options Agreement enabling the EA to acquire multiple land interests and rights to allow the delivery of the Scheme. The Agency will have an option to call for various interests in land in accordance with the Options Agreement.
To review all plans to form part of the Options Agreement, identifying the interests to be acquired and ensuring the plans of the land being acquired are fully agreed and approved by the Council.
To ensure the rights negotiated including access rights and temporary works areas are such that the Council's position is fully protected
On exercise of the Options Agreement, to liaise with Legal in respect of the transfer of the land ensuring the final plans of the land and any variations are fully agreed by the Council
To negotiate and agree the terms of licences to carry out such works as required by the EA for the purpose of the Scheme
To ensure all mitigating works required under the Options Agreement are carried out by the EA to the appropriate standard
To work with the EA in enabling the Option Land to be transferred with vacant possession including agreeing surrender terms where there is an occupational interest.
To assess and as appropriate activate call options to acquire such part of the Option Land as the Agency decides it does not require for ongoing operation and maintenance of the Scheme
To consult with other internal departments as necessary (e.g. car parks team)
To raise any issues with the internal board to address risks and recommend a course of action
To liaise with the Council's appointed agents for the agricultural estate obtaining their advice as and when required on those interests affected by the scheme and forming part of the agricultural estate
To respond to notices served by the EA as part of the process for making a compulsory purchase order such as Section 5a notices
To respond to the compulsory purchase order made by the EA to acquire the relevant rights to deliver the Scheme liaising with stakeholders and ensuring the Council's position is fully protected
To negotiate the compensation payments due to the Council in accordance with the relevant compulsory purchase legislation reporting to the Council with recommendations in respect of the various interests being acquired
To monitor internal costs and agent costs ensuring recovery within the basis agreed with the EA.
Essential Criteria
Degree level and qualified as a RICS Chartered Surveyor (General Practice).
Significant experience in managing a complex project working with a range of stakeholders.
A strong track record of negotiating complex property transactions including options agreements, land transfers, leases and access licences
Proven ability to successfully analyse complex issues and situations and provide practical and creative solutions.
Evidence of continuing professional development and a detailed understanding of property issues, opportunities, policies and legislative developments
Computer literate, ability to use Microsoft computer packages including complex Microsoft Excel spread-sheets
A proven track record in delivering tangible results and customer focused services working corporately, across boundaries and with external partners to achieve required goals.
