Conrad Consulting are currently working alongside a leading client side organisation who are after an experienced Commercial Manager to join their team based in Surrey.

Our Client: Global cleantech company operating in energy from waste (EfW) and renewable gas.

Role of the Commercial Manager:

PRE-AWARD

Provide advice and support during negotiation of commercial contract conditions with clients and partners. Review contracts and draft comments and contract clauses with specific application to the UK.Support local and main office procurement, in particular flow down and negotiation of key terms for subcontractors/suppliers.Support local commercial arrangements (such as bank guarantees, taxes, customs, and logistics in coordination with Supply Management, Legal, Finance, etc.).Review contracts and project documents for potential risks or constraints and propose responses in commercial documentation and during tender risk assessment reviews.

POST-AWARD

Primary in country point for project contract and commercial support, for lot projects, services, and warranty works.Lead assigned lot projects in contractual and commercial matters. Support project and technical managers in contract and commercial issues particularly claims, provide advice in relation to site issues as they arise, and create strategies to protect HZI and deliver the project successfully.Take responsibility for administration of client contract change management in coordination with relevant project manager, work package holder, procurement, and other staff. Support formal dispute activities but at all times pursue out of court dispute management and settlement.Ensure proper documentation, records, and reporting of events, claims, risks, and opportunities. Ensures that necessary contractual correspondence is in place and supporting documentation and records are maintained. Participate in commercial meetings with clients and contractors/suppliers.Advise on payment procedures in accordance with the contract and applicable legislation (client and subcontractor) and monitor all payments and any withholdings/retentions.Manage project bonds, guarantees, and insurance. Take responsibility for insurance matters in association with HZI insurance department and brokers.Analyse and report on project risks and proactively participate in the identification of risk reduction measures Review budgets and cost to complete together with project teamSupport procurement, including alignment of subcontract/supply conditions with client contracts, and negotiation of terms.Support warranty managers to ensure that defects are properly identified, managed and closed out with the client and contractors/suppliers.

Requirements of the Commercial Manager:

Common law legal education.Qualified QS, RICS an advantage.Scheduling proficiency an advantage. Experience in construction of industrial plant project delivery an advantageProficient with standard form (NEC, IChemE, FIDIC) and bespoke contracts, operations & maintenance agreements, service agreements an advantage.In general, the individual will demonstrate reliability, high ability to work under pressure, social competency, ability to manage conflict, assertiveness and will be service oriented.The above job duties and responsibilities describe the general nature of the work and are not intended to be an exhaustive list of all duties or responsibilities.
